1. Who we are
These terms of use govern the use of Creattero (creattero.com), a website published and operated by Simon Lacroix, a sole proprietorship registered with the Quebec enterprise registrar under NEQ 2274467762 and doing business as “Bonjour la toile” (“we”, “us”, “our” or “the publisher”).
Business address: 105-3700 Évariste-Leblanc Street, Laval, Quebec H7V 0C4, Canada.
2. Scope and acceptance
These terms apply to the creattero.com website, a guide of gift ideas for people who crochet, knit and quilt.
By visiting Creattero or sending us a message, you acknowledge that you have read these terms and agree to comply with them. If you do not agree, please do not use the site.
You represent that you are at least 14 years old, or have the consent of the holder of parental authority, and that you have the legal capacity to enter into a contract.
3. Access to the site
Access to Creattero, including its gift finder, requires neither an account nor payment. We strive to keep the site continuously available, without being able to guarantee it: an interruption may occur for maintenance, a technical failure or an event beyond our control.
4. Intellectual property
Unless otherwise stated, all elements of the site (texts, selections, illustrations, visual identity, logos, databases, source code and interfaces) are our property or licensed to us, and are protected by the Canadian Copyright Act and applicable international treaties.
You may view, download and print this content for strictly personal, non-commercial use. Any reproduction, distribution, adaptation, resale or other use requires our prior written permission.
Product names, brands, logos and product images remain the property of their respective owners. Their presence on Creattero implies neither a partnership nor an endorsement on their part.
5. Gift ideas, prices and the gift finder
Creattero presents gift ideas for general information purposes. We do not sell any product: we point to the stores that sell them.
The information about a product (name, brand, price, description) comes from the store or the maker, as of the date we checked it. Prices and availability change: the price shown on Creattero may differ from the price at the store, and the price and terms at the store are the ones that apply. Some texts, such as the short text on a product card, are drafted with the help of a language model from the facts we gathered on the product, and checked against those facts.
The gift finder picks products from your answers by fixed rules. Its suggestions are ideas, not advice: we cannot guarantee that a product will suit the person you have in mind.
6. Purchase links and Amazon Associates disclosure
Creattero is a participant in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for sites to earn advertising fees by advertising and linking to Amazon.com. As an Amazon Associate, Creattero earns from qualifying purchases. The price you pay is the same.
Links to other stores are plain links, on which we earn no commission. Whatever the store, we are not a party to your purchase: the store handles your order, payment, delivery, returns and warranty under its own terms.
A product's place on the site cannot be bought. Creattero shows no advertising from a third-party advertising network.
7. Messages you send us
The contact form and our email address let you write to us. You remain the owner of what you send. You warrant that it infringes no third-party right and no law. We respond to copyright takedown requests sent through the contact form or by mail.
8. Acceptable use
When using the site, you agree not to:
- breach any applicable law or the rights of a third party;
- extract our content in bulk, including by automated scraping, or attempt to reconstruct our databases;
- call the site or its tools at a rate that degrades their operation for others;
- disrupt the operation of the site, circumvent its security measures or access it without authorization;
- transmit malicious code, spam or content that is unlawful, defamatory, hateful or misleading;
- impersonate a person or an organization.
We may suspend or terminate your access without notice if you breach these rules.
9. Links to third-party sites
Creattero links to stores and sites operated by third parties, which is the very purpose of a gift guide. We have no control over those sites, their content, their business practices or their handling of personal information, and we accept no responsibility for them. Please consult their own terms.
10. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental or consequential damages (including loss of profits, data or business opportunities) arising from the use of or inability to use the site, from a purchase made in a store we link to, or from the use of information published on the site.
These limitations do not apply in the event of gross or intentional fault, nor to the extent that they would be prohibited by the Consumer Protection Act or any other provision of public order.
11. Personal information
The processing of your personal information is described in our privacy policy, written in accordance with Quebec's Act respecting the protection of personal information in the private sector and the Personal Information Protection and Electronic Documents Act (PIPEDA).
12. Changes to these terms
We may change these terms at any time. The applicable version is the one in effect when you use the site. The effective date appears at the top of this document.
13. Governing law and jurisdiction
These terms are governed by the laws in force in the Province of Quebec and the federal laws of Canada applicable therein.
Any dispute relating to their interpretation or performance falls under the exclusive jurisdiction of the courts of the judicial district of Laval, Province of Quebec. If you are a consumer, this clause does not deprive you of the right to bring proceedings before the court of your place of residence where the law allows it.
